1. Introduction

Welcome to Loving Care Global, a high-end nanny and family support organization specializing in professional, multilingual, and carefully screened nannies and family managers. We support international families, expats, entrepreneurs, diplomats, and families with a dynamic lifestyle.

Our services are built on four core principles:

  • Safety: we ensure a safe and trusted environment for every child.
  • Professionalism: our nannies are extensively screened and work under strict quality standards.
  • Discretion: we protect the privacy of families with the utmost care.
  • Reliability: clear communication and continuous quality control.

These Terms & Conditions apply to all services provided by Loving Care Global in both the Netherlands (Amsterdam and surrounding areas) and Spain (Costa del Sol).

2. Definitions

  • User: the parent, guardian, or client who uses services via Loving Care Global.
  • Nanny: an independently operating professional, screened by Loving Care Global, providing childcare or family support services.
  • Childcare Agreement: the agreement between the User and the nanny governing the execution of services.
  • Services: all services offered by Loving Care Global, including nanny services, family management, transportation, and last-minute care.
  • Membership: the service tier selected by the User, granting access to specific benefits and conditions.

3. Our Services

Loving Care Global offers a wide range of professional services.

3.1 Nanny Services:

Including daytime care, evening care, overnight care, recurring care moments, occasional babysitting, and long-term nanny placements.

3.2 Family Manager Services:

Professional support with family organization, planning, light household tasks, structure, and daily logistics.

3.3 Weekend & Activity Care:

Activity supervision, outings, sports activities, social events, and weekend childcare.

3.4 Pick-up & Drop-off Services:

Safe transportation to and from school, sports, activities, playdates, or after-school care.

3.5 Last-Minute Nanny:

Short-notice nanny services, subject to availability.

3.6 International & Travel Assignments:

Nannies accompanying families on international travel, holidays, or long-term stays. Travel expenses, accommodation, and surcharges apply.

4. Screening & Professional Standards

We apply a strict selection process to guarantee quality, safety, and professionalism.

4.1 Selection Criteria:

Each nanny meets the following requirements:

  • Extensive experience in childcare or pedagogy
  • Valid Certificate of Good Conduct (VOG) or international background check
  • Multiple verified references
  • First Aid / CPR certification (or mandatory to obtain)
  • Professional attitude, presentation, and communication skills
  • Multilingual abilities where possible (Dutch, English, Spanish, or others)

4.2 Code of Conduct & Discretion:

Our nannies:

  • Never share family information with third parties
  • Do not post photos or videos of children on social media
  • Work according to safety, hygiene, and professionalism standards
  • Follow reasonable instructions from the User
  • Act carefully and in accordance with our quality standards

4.3 Independent Execution:

Nannies operate as independent contractors. Loving Care Global facilitates and mediates; execution of services is governed by the Childcare Agreement between the nanny and the User.

5. Booking Procedure

5.1 Request Process:

  1. The User submits a request via WhatsApp, phone, or request form.
  2. Loving Care Global gathers details regarding wishes, schedule, location, children’s ages, and special requirements.
  3. We match the request with suitable nannies based on expertise and availability.
  4. The User receives a booking confirmation.
  5. The Childcare Agreement is concluded once the nanny accepts the assignment.

5.2 Information Provision:

The User must provide complete and accurate information regarding:

  • Number of children
  • Medical considerations
  • Allergies
  • Special needs
  • Relevant household or safety information

5.3 Use of the Service

It is not permitted to contact nannies directly for future assignments outside of Loving Care Global.

6. Rates, Surcharges & Payments

6.1 Hourly Rates:

Rates depend on:

  • Type of service
  • Time of day (day, evening, night)
  • Weekend or public holiday
  • Country (Netherlands or Spain)

Rates are communicated in advance via confirmation or invoice.

6.2 Surcharges:

  • Evening surcharge (after 8:00 PM)
  • Night surcharge (after 12:00 AM)
  • Weekend and public holiday rates
  • Travel expenses (if applicable)
  • Taxi or transport reimbursement for late shifts
  • International travel and accommodation costs

6.3 Payment:

  • Payment may be made via invoice, Tikkie, or direct payment to the nanny as instructed.
  • In the case of cash payments, the nanny is responsible for proper tax handling.

6.4 Price Changes:

Loving Care Global reserves the right to adjust rates without retroactive effect.

7. Memberships

Loving Care Global offers different service tiers.

7.1 Membership Benefits:

Depending on the selected membership, the User may receive:

  • Priority booking service
  • Personal account manager
  • Reduced service or transaction fees
  • Fixed nanny matching
  • International availability and travel assignments

7.2 Cancellation:

Memberships are cancellable monthly unless otherwise agreed in a premium contract.

8. Cancellation Policy

8.1 General Cancellation Policy:

  • Cancellation up to 24 hours before start: 50% of the scheduled service will be charged.
  • Cancellation within 12 hours before start: 100% of the service will be charged.

These conditions apply as nannies reserve time and decline other assignments.

8.2 No-Show & Unforeseen Circumstances:

  • If the nanny or User does not appear, this must be reported immediately.
  • Loving Care Global will actively mediate to find a suitable solution.

8.3 International Bookings:

Travel, accommodation, and preparation costs already incurred will always be charged.

9. Liability

9.1 Role of Loving Care Global:

We facilitate, screen, and mediate but are not a party to service execution.

9.2 Liability of User & Nanny:

  • The User ensures a safe working environment.
  • The nanny is independently responsible for her work.
  • Both parties must hold appropriate insurance.

9.3 Limitation of Liability:

Loving Care Global is only liable in cases of intent or gross negligence.
Maximum liability equals the amount of the most recently booked service.

9.4 Indirect Damage:

We are not liable for consequential damages, loss of data, or loss of profit.

10. Non-Circumvention Clause

To safeguard continuity, quality, and availability:

If the User approaches a nanny directly for future services without permission from Loving Care Global, a compensation fee of €500 per violation may be charged.

11. Privacy & Discretion

11.1 Data Processing:

We process only necessary data, including:

  • Contact information
  • Child-related safety information
  • Billing and administrative data

11.2 Data Security:

  • Secure data storage
  • Restricted staff access
  • No data sharing with third parties without consent

11.3 Photos, Media & Communication:

No photos, videos, or personal data will ever be shared without explicit permission.

12. House Rules & Safety Guidelines

12.1 Safe Environment:

The User must provide a safe and hygienic workplace, including:

  • Proper child car seats for transport
  • An environment free from hazards (open water, aggressive pets, loose cables, sharp objects, etc.)
  • Access to first aid supplies if available

12.2 Scope of Services:

Nannies do not perform:

  • Medical acts beyond first aid
  • Heavy household work (deep cleaning, window washing)
  • Tasks not agreed upon in advance
  • Activities that endanger the child or nanny

12.3 Illness Policy:

  • Mild symptoms: care possible upon consultation
  • Serious or contagious illnesses: nanny may refuse or terminate service
  • Extra care for sick children is charged at standard hourly rates unless agreed otherwise

12.4 Water Activities:

For swimming pools, beaches, or water-related activities:

  • Supervision responsibilities must be clearly agreed upon
  • The nanny may refuse activities deemed unsafe

13. Insurance

13.1 User Responsibility:

The User must hold valid personal liability insurance covering third-party damage.

13.2 Nanny Responsibility:

As independent contractors, nannies must:

  • Hold professional liability insurance
  • Insure personal belongings independently

13.3 No Insurance by Loving Care Global

Loving Care Global does not provide insurance coverage.

14. International Assignments

Additional conditions apply for assignments outside Amsterdam & Costa del Sol.

14.1 Travel Costs:

  • Flights fully covered by the User
  • Baggage costs (1 suitcase + carry-on) included
  • Taxis, transfers, and local transport covered by the User

14.2 Accommodation:

  • A separate, safe, and clean sleeping space is required
  • If unsuitable, the nanny may book alternative accommodation at the User’s expense

14.3 Working Hours & Rest:

  • Minimum 8 hours of rest per 24 hours
  • Clear work and rest schedules agreed in advance
  • Active supervision during travel may count as working time

14.4 Daily Allowance:

If meals are not fully provided, a daily allowance applies.

15. Payment Terms & Invoicing

15.1 Payment Term:

Invoices must be paid within 7 days unless agreed otherwise.
Late payments may incur a 10% surcharge plus collection costs.

15.2 Advances:

For international or long-term bookings, a 30–50% advance payment is required.

15.3 Non-Payment:

In case of non-payment:

  • Future bookings may be suspended
  • Membership may be terminated

16. Nanny Takeover

If the User directly engages a nanny for future services, recurring care, or long-term placement without Loving Care Global’s involvement, a compensation fee of €2,500 per violation will apply.

This aligns with international high-end nanny agencies and ensures fairness toward our professionals.

17. Complaints Procedure

17.1 Submitting a Complaint:

Complaints may be submitted via email or WhatsApp.

17.2 Response Time:

Within 7 business days, we provide:

  • Confirmation of receipt
  • An investigation plan

17.3 Resolution:

We aim to resolve complaints within 14 days.

18. Force Majeure

Loving Care Global is not liable for delays or cancellations due to circumstances beyond our control, including:

  • Illness
  • Traffic issues
  • Extreme weather
  • Technical failures
  • Government measures
  • International travel disruptions

19. Duration & Termination of Childcare Agreements

19.1 Long-Term Placements:

For recurring services:

  • 14-day notice period applies
  • Termination must be in writing

19.2 Unprofessional Conduct:

Loving Care Global may terminate cooperation immediately in cases of:

  • Unsafe situations
  • Disrespectful or inappropriate behavior
  • Repeated late payments

20. Privacy & GDPR Compliance

20.1 Data Processing:

Personal data is processed solely for:

  • Safety
  • Matching
  • Administration
  • Invoicing

20.2 User Rights:

Users have the right to:

  • Access personal data
  • Correct data
  • Request deletion (where legally permitted)
  • Data portability

20.3 Retention Periods:

  • Contracts: 5 years
  • Financial records: 7 years (legal requirement)
  • Profiling & matching data: max. 12 months after termination

20.4 Media & Images:

Nannies never take or share photos or videos without explicit written consent.
No media is shared via WhatsApp, social media, or third parties without permission.
